Part 1: Messaging terms for consumers
What the program is
When you send a text to a business’s Textstr-enabled phone number, or submit your mobile number through a “Text Us” widget on a business’s website, you start a two-way conversation with that business. You will receive a one-time confirmation text, and then replies from the business’s staff about the enquiry you made, for example a sales question, a service appointment, or a parts order. This is conversational customer care messaging, not a marketing list.
Consent
By texting a Textstr-enabled number, or by entering your number in a Text Us widget and pressing send, you agree to receive text messages from that business at the number you provided. Consent is not a condition of purchasing any goods or services.
Frequency, cost and opting out
- Message frequency varies with how often you and the business write to each other.
- Message and data rates may apply according to your mobile plan.
- Reply STOP at any time to stop receiving texts from that number. You will get one final message confirming you have opted out.

- Carriers are not liable for delayed or undelivered messages.

Part 2: Terms for subscribing businesses
The service
Textstr text-enables a phone number you control, delivers incoming texts to the email addresses and web inbox you configure, and sends your replies back to the customer as texts. We provide the number, the carrier connection, the inbox and the website widget. You provide the replies.
Your account
You are responsible for keeping your login details confidential, for everyone who uses your account, and for keeping the list of email addresses that receive customer messages accurate. Tell us promptly if you believe your account has been accessed without permission.
Acceptable use
You agree that you and your staff will:
- Only text customers who have contacted you first, or who have otherwise given you clear consent to be texted.
- Honor every STOP request. Textstr blocks further sends to a number that has opted out, and you must not try to reach that number another way.
- Not send marketing broadcasts, bulk messages, or anything unlawful, deceptive, threatening or obscene through the service.
- Comply with the Telephone Consumer Protection Act, the CAN-SPAM Act, Canada’s Anti-Spam Legislation where applicable, carrier messaging policies, and any other law that applies to your messages.
We may suspend or terminate an account that breaks these rules, and we may be required to do so by our carrier partners.
Fees and billing
Fees are those quoted when you sign up or as later agreed in writing, billed monthly in advance to the payment method on file. Prices may change with thirty days’ notice. Accounts more than thirty days overdue may be suspended. Fees are non-refundable except where the law requires otherwise.
Term and cancellation
Service continues month to month until either of us cancels. You may cancel at any time by email, effective at the end of the current billing period. When an account closes, the phone number is released and the conversation history is deleted from our production systems.
Your customers’ data
You own the content of your conversations. We process it only to provide the service, as described in our Privacy Policy. You are responsible for handling your customers’ information lawfully once it reaches your email and staff.
Availability and disclaimer
We work to keep the service available around the clock, but it depends on mobile carriers, email delivery and hosting providers we do not control, and we cannot promise uninterrupted or error-free operation. The service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Textstr’s total liability for any claim arising from the service is limited to the fees you paid us in the three months before the claim arose, and we are not liable for indirect, incidental or consequential damages, including lost sales or lost data.
Governing law
These terms are governed by the laws of the State of Washington, and any dispute will be brought in the state or federal courts located in Thurston County, Washington.
Changes
We will post any changes here and update the effective date at the top. Continued use of the service after a change means you accept the updated terms.
